How can I Finish My Divorce the Fastest Way in San Diego Superior Court in 2014: One Day Divorce Option?

ONE DAY DIVORCE OPTION STARTS MARCH 1, 2014 IN SAN DIEGO SUPERIOR COURT

In San Diego, filing for a divorce can be a time consuming process and take months if not years. Many spouses and parents dream of getting their divorce finished in one day!. What if there was an option to get your divorce done in 1 day? Would you consider this? Starting March 1, 2014, this is an available option. This program is only live at the main Family Law Court House located on Sixth and Cedar downtown San Diego starting March of 2014. Be advised there are many restrictions and research carefully but this divorce option may be for you.

WHAT ARE THE REQUIREMENTS FOR THE ONE DAY DIVORCE OPTION?

The petition and summons for divorce needs to be filed and served. After this initial service and filing and after the six month waiting period, the spouses meet with an expert in family law at the court house who will discuss the exact terms and conditions of the divorce settlement agreement which is proposed in a default judgment process. Neither spouse in the divorce can be represented by an attorney and there must be agreement on all issues. If all of these requirements are met, then the mandatory forms necessary to complete the divorce are executed and the parties can appear in court the same day! If all is accepted by the Judge, then the spouses can leave the Court with a judgment. This does not mean that the six month period from date of filing to date of termination of legal status is one day and the date when the parties are legally single and eligible to remarry will be placed on the Judgment which is why the time period is to make sure the petition and summons was served at least six months prior. The San Diego Superior Court website has additional requirements and the ones above are not all inclusive and used for illustration purposes of this topic only.

WHAT DO I DO IF I DO NOT MEET THE REQUIREMENTS FOR THE ONE DAY DIVORCE OPTION?

In many divorce cases, there are issues of custody, visitation, child support, spousal support, division of assets and division of debts and not all spouses will agree on all issues. If you disagree on even one issue, then the one day divorce is not an option. There are, however, other options other than litigation. For example, as a resource, there is the Family Law Facilitator’s Office. This is a San Diego County Department which assists self represented litigants in preparing pleadings and the procedure of family law. The Family Law Facilitator is located in each of the following court houses in San Diego County: San Diego main family law courthouse; El Cajon courthouse; Chula Vista courthouse and Vista court house. This resource is no charge for the litigants. Other examples include the use of Special Masters and Alternative Dispute Resolution.
