California’s Uniform Premarital Agreement Act defines prenuptial agreements in the state of California. Additionally, Section 1610 of the California Family Law Code defines what a premarital agreement is, what property it can include, and other pertinant details. Section 1611 says that such agreements also must be in writing. Couples cannot include sections related to children, child support, custody, daily household obligations, household chores, sexual relations, or adultery penalties.
