2014: Court Holidays for Divorce, Paternity and Legal Separation Cases in San Diego County

Why Is It Important To Know The Court Holidays For Your Paternity, Legal Separation Or Divorce Case In San Diego Superior Court?

There are strict filing deadlines with time periods and some use “calendar days” and some use “court days”. This can make the different between a timely filing and non timely filing. In addition to the holidays, the San Diego Superior Court for Family Law Cases such as legal separation, paternity and divorce cases is closed on each Friday at 12pm. For example, if a motion for custody and visitation is served on you for a legal separation, divorce or paternity case, you must file your responsive pleadings within the local rules of the San Diego Superior Court. If this is served in the middle of November of 2014, for example, the Court is closed on Thanksgiving and the Day After Thanksgiving and then, of course, on Saturday and Sunday. As such, if you are served one week before Thanksgiving, this will mean two court holidays will need to be taken into consideration for any responsive filing deadlines. In addition, it is very frustrating to travel to the court house [whether downtown San Diego, Chula Vista, Vista or El Cajon] only to find the court house closed or the Clerk’s Office closed and have wasted several hours.
