If you live in Rancho Bernardo, the San Diego Superior Court which will be assigned your case is either the main family law court house on 6th Avenue or the Madge Bradley court house on 4th Avenue. There are six family law departments in the main courthouse and two family law departments in the Madge Bradley which hear divorce, legal separation and paternity cases. The assignment is by independent calendar. These court houses hear the issues of custody, visitation, spousal support, child support, division of debts and division of assets. The Judges will make orders which involve your parenting plan, whether you will pay or will owe child support, whether you will owe or will pay spousal support and what assets and debts will be divided. In addition, family court services is located in the main family law courthouse and not in the Madge Bradley even though your hearing may be at the Madge Bradley.

Driving to the downtown court houses, especially during rush hour, can be very stressful. Make sure to be on time and, if at all possible, early. This will give you time to collect your thoughts and prepare for either the mediation or the court hearing. There are meters outside the courthouses but these are, at a maximum, two hours so you may want to find the least expensive parking lot as the last thing you want to be thinking of at your court appearance or mediation is whether or not you will get a parking ticket. On some streets, if you do park at the meters, be very careful since some are “no parking” at certain times [for example 4pm-6pm] and your car may be towed even if you have enough money in the meter.

Your participation verbally may be required at the hearing and the same with your spouse. In addition, it is very important to review your pleadings for accuracy as, sometimes, circumstances change and the pleadings may need to be updated. For certain hearings, such as support, it is mandatory to update your income and expense declaration so that it is current at least 90 days before the hearing.
